Terms and Conditions of Electronic Services and Sale of Goods

These Terms and Conditions constitute the terms of electronic services in accordance with Article 8(1)(1) of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2002, No. 144, item 1204, as amended), taking into account the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827).

§ 1. General Provisions

  1. The Seller is K&K Investment sp. z o.o., 34-206 Krzeszów 59, Poland, NIP: 5521703853, REGON: 121380575, KRS: 0000368782.
  2. The online store operates under two domains:
    • chlopcyzrancza.pl – Polish market; settlement currency: PLN; contact: bok@chlopcyzrancza.pl, tel. +48 530 900 992; support on business days from 9:00 to 16:00.
    • ranchboys.eu – European Union markets (excluding Poland); settlement currency: EUR (or other, according to the region selected in the Store); contact: boys@ranchboys.eu.
  3. These Terms set out the rules for using the Store, placing orders, concluding and performing sales contracts, and the rights and obligations of Customers and the Seller.
  4. When using a given domain, the provisions applicable to that domain apply accordingly (in particular currency, delivery costs and methods, contact address).
  5. The Store provides content and service at least in Polish and selected EU languages (e.g., English, German, French); language versions are equivalent for information purposes.

§ 2. Definitions

  1. Seller – K&K Investment sp. z o.o.
  2. Store – the Seller’s sales service available under the domains chlopcyzrancza.pl (PL) and ranchboys.eu (EU).
  3. Customer – a natural person, legal person, or organisational unit with legal capacity, making purchases in the Store.
  4. Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity.
  5. Newsletter – commercial information sent electronically to Customers who have consented to receive it.

§ 3. Conditions for the Provision of Electronic Services

  1. Using the Store requires:
    • an Internet connection,
    • a current web browser with cookies and JavaScript enabled,
    • an active email account.
  2. The Seller does not provide devices or software necessary to use the Store.
  3. Using electronic services may involve the risk of third-party interference in data transmission over a public network.
  4. The Customer is obliged not to provide unlawful content.

§ 4. Electronic Services (Customer Account)

  1. The Customer may create an account in the Store free of charge by registering and activating it.
  2. Account maintenance is provided for an indefinite period; the Customer may resign at any time.
  3. Account cancellation should be reported to the appropriate address:
    • for the Polish market: bok@chlopcyzrancza.pl,
    • for EU markets: boys@ranchboys.eu.

§ 5. Placing Orders and Concluding the Contract

  1. Information about products (descriptions, specifications, prices) constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  2. An order can be placed without creating an account or after logging in.
  3. To place an order, the Customer provides the data necessary for execution (name/company name, email address, delivery address, phone number, invoice details – optional).
  4. The sales contract is concluded when the Store confirms acceptance of the order (email message).
  5. The Customer and the Store are bound by the price valid at the time of placing the order.

§ 6. Prices, Currencies, and Payments

  1. Prices:
    • PL (chlopcyzrancza.pl) – prices given in PLN, as gross prices (including VAT).
    • EU (ranchboys.eu) – prices generally given in EUR as gross prices; depending on the selected country/region and currency in the Store, prices may be presented in another currency available for that market.
  2. Available payment methods may include: bank transfer, online payment gateways, payment cards, e-wallets (e.g., PayPal), and payment systems provided by the e-commerce platform. Exact options and any restrictions are presented during checkout depending on the market/domain.
  3. Refunds for card transactions are made to the account assigned to that card.
  4. Payment deadline:
    • for prepayment – immediately after placing the order, no later than within 7 business days,
    • for cash on delivery (if available) – upon delivery.

§ 7. Delivery and Costs

  1. Delivery methods and costs are displayed in the cart and depend on the destination country, payment method, and parcel size/weight.
  2. The order processing time is up to 30 days from the conclusion of the contract, unless the product description or a message during checkout indicates a shorter period.
  3. Delivery is carried out via postal operators and courier companies appropriate for the given market (domestic or international).

§ 8. Complaints (Warranty)

  1. The Seller is obliged to deliver goods without defects.
  2. In the event of a defect, the Customer may submit a complaint electronically to the appropriate address:
    • PL: bok@chlopcyzrancza.pl,
    • EU: boys@ranchboys.eu.
  3. The complaint should include the Customer’s data enabling transaction identification, a description of the defect, and – if possible – photographic documentation.
  4. If the information provided in the complaint needs to be supplemented, the Seller will request the missing information.
  5. The Seller will respond to the complaint within 14 days of receipt.

§ 9. Right of Withdrawal (Consumers)

  1. The Consumer has the right to withdraw from a distance contract within 14 days without giving any reason, subject to the exceptions provided for in the Consumer Rights Act.
  2. The withdrawal statement may be sent to the appropriate email address (PL: bok@chlopcyzrancza.pl; EU: boys@ranchboys.eu) or in any other way permitted by law.
  3. The returned goods should be sent to the address indicated by the Seller after accepting the withdrawal statement.

§ 10. Customers Who Are Not Consumers

  1. For non-consumer Customers, the Seller may limit available payment methods and make execution conditional on prepayment.
  2. The Seller’s liability for non-performance or improper performance of the contract is limited to the amount paid and delivery costs; the Seller is not liable for lost profits.

§ 11. Copyright

  1. All works and materials (including photos, descriptions, graphics) available in the Store are subject to copyright of the Seller or third parties and are legally protected. Use outside the permitted scope requires the consent of the rights holders.

§ 12. Personal Data Protection

  1. The administrator of Customers’ personal data is the Seller. Data is processed for order fulfilment, after-sales service, and – with consent – for sending newsletters.
  2. Providing data is voluntary but necessary to conclude and perform the contract. The Customer has the right to access their data and correct it, as well as other rights under applicable data protection laws.

§ 13. Amendments to the Terms and Governing Law

  1. The Seller reserves the right to amend the Terms. Customers will be informed of changes by publishing a consolidated text in the Store and a message upon login or by sending information to the Customer’s email address (if they have an account).
  2. Contracts concluded via chlopcyzrancza.pl are governed by Polish law. Contracts concluded via ranchboys.eu are governed by Polish law and the applicable consumer law of the country of delivery.
